Palin’s mail hacker charged with 3 more crimes

A University of Tennessee student accused of illegally breaking into the email account of Alaska governor Sarah Palin has been hit with three new felony charges in connection with the case. David Kernell on Monday pleaded not guilty to the new charges, which include fraud, unlawful electronic transmission of material outside Tennessee and attempts to conceal records to impede an FBI investigation. Previously, he was charged with a single felony count of unauthorized access of a protected computer. The new counts come as defense attorneys not involved in the case have roundly criticized the soundness of the the previous charge. Under US law, unauthorized access of a protected computer should be charged as a misdemeanor except when it’s used to further a separate crime. Prosecutors had argued that the other crime was the unauthorized access of Palin’s email account. That prompted critics to argue prosecutors were applying circular reasoning.

In September, while Palin was the Republican vice presidential candidate, Kernell used publicly available information to reset her Yahoo! email account, according to an indictment filed in the case. Prosecutors followed a string of breadcrumbs Kernell allegedly dropped, including the sloppy use of an anonymous proxy service and a first-person account left on hacker website 4chan.org. The case drew international headlines after a handful of material from Palin’s account was posted on Wikileaks. A trial in the case has been rescheduled for October 27. It had previously been slated for May. Kernell is the son of state Representative Mike Kernell, chairman of Tennessee’s House Government Operations Committee.

If she was in power we would be building huge billion dollar natural gas pipelines in Alaska and massively stimulating Americas economy with productive work and energy. But instead, Obama just wants to hand out a bunch of money to those who do not deserve it, completely destroying Americas infrastructure.

    Anyways, I'm glad I live in Alaska where there is still plenty of high paying work to go around. Anyone with a highschool diploma could make 6 figures here if you're willing to work. THAT IS HOW IT IS SUPPOSE TO BE. I feel sorry for the rest of you down in the states.

    she comes from Alaska… its a friggin welfare state who would be so drastically different and probably not even a state if it wasnt for the oil. She would be horrible and useless as a VP, and even worse as a president. That said i would have think John McCain would have done better in power so far, hes not nearly as concerned with re-election and the hard decisions would be made. Now were trying to fix the economy, cover everyone, give jobs and rights to illegal-immigrants, and a slew of other things Barack promised. Add that to the fact that he came on a notion of doing everything backwards from Bush and we have our military standing down when provoked across the world most recently by a bunch of smaller chinese vessels who threatened the boat.

    Barack may be the better choice im not sure but i dont like what happening so far.

    AS for the hacker, people like him need to be made examples of. But this guy seemeed like an idiot and its lucky no one else smarter decided to do this or they would have been able to cover their tracks.

    You don't have to live in the icy tundra to get that, Alaska is just some chunk of frozen crapland that even Russia didn't want so they sold it to the US.

    Pretty cool to look at and visit (much like a zoo is) but I sure as hell wouldn't want to be stuck living there.

    It is (was) easier to make 6 figures in the us then other countries based on ingenuity, education or being able to think outside of the box and NOT join the labor ranks.

    Things have gotten tough because of the stupidity and greed of a few. I dont honestly see how no one in power saw this housing crisis coming. THe banks were issuing loans and selling the loans to other countries based soley on the fact that every year the house would go up 6-10% like clockwork so that even if the person defaulted the house would be profitable in auction, that was what made the loans attractive to everyone. How come no one looked at that and saw how dumb that was. Next, the people that got the loans are dumbasses who deserve to be made homeless. They are mostly lower income lower education morons who pretended not to know what was going on, i dont have a house i would have loved to buy one but i cant afford it making $500 a week. The people that said to themselves "i make $2k a month so a $1k mortgage is fine" deserve what they got.

    Sorry for the hugely off topic rant im just sick of this greed by the rich and stupidity by the poor.

    But back on topic, Palin is a moron who was used by the republicans and it almost worked. And this hacker(barely a hacker) needs to get years in prison.

    it's easy to track someone down. the FBI merely got records from Yahoo to see what IP# logged in under her name and at what date/time. They narrow it down to the IP#'s that are not used by Palin.

    Even if you go to an internet cafe or w/e, if there's a security camera around (and there usually are), they just review the security tapes and see who's in view during the exact time that the cafe's IP# accessed her email account.

    This is just some common sense techniques. I'm sure the FBI have a ton more resources, supergeeks, equipment, manpower, etc. at their disposal. Hacking is a serious crime now.

    A wifi hotspot… aka an open network somewhere, not that hard to find an unsecured wifi connection somewhere.

    A computer that has never been used for anything that can be tracked to you.

    Clothing that makes you less "recordable", in case cameras along the way or at the place records you. (this applies to being recognized or describable.. by others.

    Throw in tor, proxie servers in various forms, and a few other less used "tricks" and::::::::::::

    the idiot would have not been caught.

    Think about it, if i used a computer that I bought with cash, used. Redid the entire computer, never used it for anything other then "bad" stuff, and followed the stuff above, how could they have caught ya.

    Glad I am not into that stuff.

    well "common sense", you don't make much sense at all. An unsecure wifi and untraceable computer (e.g. bought 2nd hand using cash) would be enough.
    If the FBI were that good, why 68% of crimes are left unsolved??? They're just human and their methods as imperfect as themselves, so you just need to be a bit less imperfect than them to trick them.
